Terms of Service

1. Acceptance of Terms

By accessing or using ResetKit ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, customers, merchants, and/or contributors of content.

2. Description of Service

ResetKit provides authentication infrastructure including:

• Password reset flows
• Two-factor authentication (email and TOTP)
• Magic link authentication
• Webhook integration
• Analytics and logging

The Service is provided via API, web widgets, and dashboard interface. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with 30 days notice.

3. Account Registration

To use ResetKit, you must:

• Provide accurate, current, and complete information
• Be at least 18 years old
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You may not share your account with others or create multiple accounts to circumvent plan limits. We reserve the right to suspend or terminate accounts that violate these terms.

4. Acceptable Use

You agree NOT to use ResetKit to:

• Violate any laws or regulations
• Send spam, phishing attempts, or malicious content
• Harass, abuse, or harm others
• Impersonate any person or entity
• Reverse engineer, decompile, or attempt to extract source code
• Overload or attack our infrastructure (DDoS, pen testing without permission)
• Resell the Service without written authorization
• Store or transmit illegal content

Violation of acceptable use may result in immediate account suspension without refund.

5. Billing and Payment

5.1 Pricing

Pricing is available at resetkit.dev/pricing. All fees are in USD and exclude applicable taxes. We reserve the right to change pricing with 30 days notice to existing customers.

5.2 Free Trial

New accounts receive a 14-day free trial. No credit card required to start. After the trial, you must add payment to continue using the Service. Trial accounts are limited to prevent abuse.

5.3 Billing Cycle

Subscriptions are billed monthly or annually in advance. Charges occur on the same day each billing period. Failed payments result in account suspension after 3 days. Accounts are deleted after 30 days of non-payment.

5.4 Refunds

We offer full refunds within 30 days of first payment if you're unsatisfied. Email support@resetkit.dev. After 30 days, refunds are at our discretion. Refunds for partial months are prorated.

5.5 Cancellation

Cancel anytime from your dashboard. Cancellation takes effect at the end of your current billing period. You retain access until then. No refunds for unused time except as stated above.

6. Data and Intellectual Property

6.1 Your Data

You retain all rights to data you input into ResetKit (user emails, reset logs, etc.). You grant us a license to process this data solely to provide the Service. We will not sell, share, or use your data for any other purpose.

6.2 Our Platform

ResetKit and its original content, features, and functionality are owned by ResetKit and are protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without explicit permission.

6.3 Feedback

If you provide feedback, suggestions, or ideas about ResetKit, you grant us unlimited rights to use, modify, and incorporate that feedback without compensation or attribution.

7. Service Availability

7.1 Uptime

We strive for 99.9% uptime (excluding scheduled maintenance). Agency plan customers receive SLA credits if we fall below this threshold. Downtime credits do not apply to issues caused by factors outside our control (DDoS attacks, DNS failures, your infrastructure).

7.2 Maintenance

We may perform scheduled maintenance with 48 hours notice. Emergency maintenance may occur without notice but will be communicated via status page and email.

7.3 Rate Limits

API rate limits exist to ensure service stability. Current limits are documented at resetkit.dev/docs. Exceeding limits may result in temporary throttling. Contact us if you need higher limits.

8. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The Service will be uninterrupted, secure, or error-free
• Results obtained from the Service will be accurate or reliable
• Any errors will be corrected
• The Service will meet your specific requirements

Use of the Service is at your sole risk. We are not responsible for any damages to your systems or data resulting from use of the Service.

9. Limitation of Liability

IN NO EVENT SHALL RESETKIT, ITS DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF YOUR USE OF THE SERVICE.

Our total liability to you for all claims arising from use of the Service is limited to the amount you paid us in the 12 months prior to the claim. Some jurisdictions do not allow limitation of liability, so this may not apply to you.

10. Indemnification

You agree to indemnify and hold harmless ResetKit from any claims, damages, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) content you submit through the Service.

11. Termination

Either party may terminate this agreement at any time:

• You: Cancel via dashboard or email support@resetkit.dev
• Us: Terminate for violations of these Terms or for any reason with 30 days notice

Upon termination, your access to the Service ends immediately. Your data will be deleted after 30 days unless you export it. Sections 6, 8, 9, 10, and 12 survive termination.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Minnesota, United States, without regard to conflict of law principles. Any disputes must be resolved in the state or federal courts located in Hennepin County, Minnesota.

You agree to first attempt to resolve disputes informally by contacting support@resetkit.dev. If unresolved after 30 days, either party may pursue legal action.

13. Changes to Terms

We may revise these Terms at any time. Material changes will be notified via email 30 days in advance. Continued use after changes constitutes acceptance. If you disagree with changes, cancel your account before they take effect.

14. Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and ResetKit
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect
• Waiver: Failure to enforce any right does not waive that right
• Assignment: You may not assign these Terms without our consent. We may assign freely.
• Force Majeure: We are not liable for delays caused by circumstances beyond our control
